If you want to marry your Filipina fiancée in the United States, start with one important question: Will she come to marry you and live here, or will she return to the Philippines after the wedding?

These are different plans with different visa requirements. A wedding in America does not, by itself, give your fiancée permission to remain permanently.

Marry My Fiancée and Begin Our Life in America

For an eligible unmarried couple who plan to marry and live together in the United States, the K-1 fiancée visa is the route designed for that purpose.

The process begins with the American citizen’s fiancée visa petition. After petition approval, your fiancée completes the visa application process, medical examination, and embassy interview.

Once she enters the United States with her K-1 visa, you must marry within 90 days. After your marriage, she applies for permanent residence through the adjustment of status process.

You should already intend to marry before starting. The 90-day period gives you time to hold your wedding after arrival.

Can We Marry While She Visits on a Tourist Visa?

Yes. A visitor can marry in the United States and then return home. A K-1 visa is not required simply because the wedding takes place in America.

For example, your fiancée may visit temporarily, marry you during the trip, and return to the Philippines before her authorized stay ends. You can then pursue the spouse visa process for her future move to the United States.

The important conditions are straightforward:

• Her visit must be genuinely temporary.
• She must answer visa and border questions truthfully.
• She must follow the conditions of her admission and leave on time.

Under those circumstances, the marriage itself does not violate her visitor status.

Why We Do Not Recommend a Tourist Visa as a Shortcut

If your real goal is to bring your fiancée to America permanently, we recommend preparing for the appropriate fiancée or spouse visa process from the beginning.

A tourist visa application adds another application, expense, and uncertain outcome. She must qualify as a temporary visitor, and having an American fiancé does not guarantee approval.

Even an existing tourist visa does not guarantee admission. Border officers decide whether to admit her when she arrives.

We do not recommend entering as a tourist with a prearranged plan to marry and remain permanently. That differs from an honest temporary visit followed by a return home.

What Happens If She Returns Home After Our Wedding?

Once you legally marry, you pursue the spouse visa route rather than a new K-1 fiancée visa petition. The spouse visa is also known as a CR-1 visa.

Your wife can return to the Philippines while you prepare and complete the immigrant spouse visa process. The fact that you held your wedding in the United States does not, by itself, prevent that process.

Keep your official marriage certificate and evidence of your relationship. These records help support your spouse visa package.

Returning home on time fulfills the departure requirement for her visit. However, it does not cancel any separate issue involving false statements or other violations.

Who Can Use the K-1 Fiancée Visa Route?

The main requirements include:

• The petitioner must be a U.S. citizen.
• Both partners must be legally free to marry.
• You must intend to marry within 90 days of her K-1 arrival.
• You generally must have met in person during the two years before filing, unless a qualifying exception applies.

How Long Does the Process Take?

Processing times change. USCIS review, document preparation, medical examinations, and embassy scheduling all affect the journey.
