K-1 vs CR-1 Visa: Which Is Right for You?

Comparing the K-1 vs CR-1 Visa

Should you marry in the United States or marry first and bring your spouse to America? Comparing the K-1 vs CR-1 visa starts with your wedding plans and the steps you want to complete before and after arrival.

Both routes help eligible couples build a life together. However, they differ in when you marry, when permanent residence begins, and what paperwork follows. Here are the main advantages and considerations for Philippine couples.

K-1 Fiancée Visa: Marry in the United States

The K-1 route is for an unmarried couple with a U.S. citizen petitioner who intends to marry their foreign fiancée within 90 days of her arrival.

Advantages:

• You can hold your legal wedding in the United States.
• You do not need to complete an overseas marriage before beginning the petition.
• You can plan your wedding and start your married life together in America.

Things to consider:

• You must already intend to marry when you apply. The 90 days are a marriage deadline, rather than a trial period for deciding whether to marry.
• After marriage, your wife applies for adjustment of status to obtain her green card.
• She cannot start working simply because she arrived on a K-1 visa. Once she becomes a permanent resident, she can work without a separate work permit. A work-permit application while waiting is optional.

CR-1 Spouse Visa: Marry Before Immigration

The spouse visa route is for couples who are already legally married. Your wife completes immigrant visa processing before moving to the United States.

Advantages:

• You can marry in the Philippines or another location where your marriage is legally valid.
• Your wife enters the United States as a permanent resident.
• She does not need adjustment of status after arriving through this route.
• Her permanent resident status authorizes her to work without a separate work permit.

Things to consider:

• You must complete the legal marriage and obtain the required marriage records.
• Wedding arrangements, travel, and local marriage requirements need advance planning.
• You may spend part of your early married life apart while the case is processed.

K-1 vs CR-1 Visa: Timing and Costs

Processing times change, so neither route should be described as always faster. Compare current estimates alongside your wedding plans and readiness to begin.

For costs, consider the whole process. The K-1 route includes adjustment of status after marriage, with additional government fees. The spouse route completes permanent residence processing before arrival. Travel, medical examinations, and document expenses also affect your budget.

What Does IR-1 Mean?

If your marriage is less than two years old when your wife enters as a permanent resident, she generally receives conditional residence through the CR-1 category. If it is at least two years old at entry, the IR-1 category generally applies.
